Doubt two: We make Takfeer of the rulers because they help the Kuffar against the Muslims

The reply: Firstly not every helping the kufaar against the Muslims necessitates Takfeer and expulsion from the religion rather there is a detailed explanation so sometimes it can be a sin that does not necessitate Kufr Akbar and if they are (the Kuffar) are aided because of their religion this is Kufr Akbar (major disbelief) as for helping them because of the Dunya (worldly life) then in this case Takfeer is not made this is what the Ulama (scholars) have said the evidences elude too and the detailed explanation.

Sheikh Fawzaan said in his book: Sharh Nawaqidul Islam (explanation of the nullifies of Islam) pg 158-160

The first category: “To help them (the Kuffar) against the Muslims with love what they are upon of Kufr and Shirk and misguiding so this category no doubt is Kufr Akbar which expels one from the religion, so whoever helps and aids them against the Muslims with love of their deen (religion) and what they are upon and he is pleased with them and he has chosen this and he is not forced in this case this is Kufr Akbar that expels him from religion because of the apparent statement of Allah subhana wa ta’ala “So indeed you are from them”.

Category Three: “Whoever helps  the Kuffar against the Muslims  and he choses this and is not forced but he hates the religion of the Kuffar and he is not pleased with them then no doubt this is a major sin (kabira) from the major sins and it is feared for him Kufr”

Secondly the  People of Knowledge differed over using the Kuffar against Muslims rebels (insurgents).  They had two opinions

First opinion: It is not permissible  to use the Kuffar against the insurgents rather it is upon the Muslims to fight them (the rebels) themselves when there is a need without the help of the Kuffar this is the saying of the Jamhoor (majority) and from them are the Malikees, Shafees, the Hanbalees and the People of the Thahiree opinion.

And they used the  following as evidence;

1. That using the Kuffar against the Muslim insurgents would cause the Kuffar to have control over them (the Muslim rebels) and Allah said “And never will Allah grant to the disbelievers a way (to triumph) over the believers”. (Surah Nisa Ayah 141).

2. The aims and objectives (of the Muslims) is to stop the insurgents and for them to return to obedience not to kill them and because of this  there is no need for the help of the Kuffar.

These scholars who viewed that it was impermissible to use the Kuffar against the Muslim rebels fell into two categories;

Category One: Those that viewed that it was not permissible to use the help of the Kuffar against the insurgents absolutely even if there is a dire need these were the Malikees (scholars).

Category Two: And this is the saying of many scholars rather they viewed it permissible to seek their help when there is a dire need and this is the opinion of  the Sha’fees, the Hanbalees and the Thahiriya.

Second opinion: That it is permissible to use the Kuffar against insurgents and this is what was understood from the speech of the Hanafees.

Editors comments: So what we understand from the above is that the Ulama differed on the permissibility of this issue and some veiwed that it was permissible with dire need so we advice those who rush quickly to Takfeer of Muslim governments to research further into this and refer back to the Senior Scholars.
