Refuting the false principle of the permissibility to use weak hadith in virtuous actions (fadail amal)

Sheikh Mashoor narrates in Ih’dai’ Thawaabi Qiraa’ati Al Quraan lil Amwaat (The ruling of giving the reward of reciting the Qur’aan to the dead) pg 35-36 that Sheikh Albani said in Tamaamul Minna, pg 234; “Principle 12: Not using the daeef (weak) ahadeeth for Fadail Amal (virtuous actions). It is well known amongst a lot of the people of knowledge and their students that it is permissible to use weak ahadeeth as a proof to perform virtuous actions. And they thought that there was no difference of opinion in this issue. How is this? And Imam Nawawi (rahimullah) relayed a consensus in more than one of his books, and what he relayed needs some clarification because the difference of opinion in this issue is known”.”Indeed some of the Ulama who researched into this issue ruled that it is not permissible to use these weak ahadeeth absolutely, not in akhaam (rulings) and not in fadaail a’maal (virtuous actions)” (End Quote).

So Sheikh Mashoor relates that Sheikh Qaasimee (rahimullah) said in ‘Qawaaidul tu Ahadeeth pg 94, that this is the mathhab (opinion) of Imam Bukhari, Imam Muslim and the mathhab  of Imam Ibn Hazm”.

Sheikh Mashoor Hasan said; “This is the truth with no doubt in my opinion, due to the following reasons;

Firstly, because what we extract from weak ahadeeth is that there is an element of doubt, so by consensus it is not permissible to use these weak ahadeeth. So whoever does not adhere to this consensus and views that it is permissible to use weak ahadeeth in fadaail amal is that it is a must that he brings his evidence.

Secondly, what I understood from the speech of those scholars who said it is permissible to use weak hadeeth in virtuous actions, actually means those weak hadeeth can be used to do actions that are already established in the Sharia”. (End quote)
